It is impossible to stop people breaking copyright laws in the digital age
Discuss this statement using your knowledge about media regulation, productions nad distribution of digital products
In this essay i will explain why it may or may not be impossible to stop people from breaking copyright laws in this digital age. Theories such as Gauntlets, uses and gratification, Jenkins and Livingstone and Lunt.
One Reason it is impossible to stop people breaking copyright laws is due to the idea of inspiration. This due to Gauntlet's identity theory as he discusses how media influences self-identity and self understanding he argue that media provides tools that shape how we understand ourselves and the world his research found is that people use media content to construct their identities and explore the diverse ways they could be. This as a result can justify why you cant stop people from breaking copyright as some people don't see it as copyright but instead inspiration and being influenced to create their own media product that are similar due to relating or having such a string close relation to what they have seen. This can be seen through the example of Ed Sheeran thinking out loud song which was taken to court over copyright yet he just took inspiration from a songs rhythm.
Another reason why it is impossible to stop people breaking copyright laws is due to the idea of how big the world of media is. This is due to Livingstone's and Lunt's theory, this shows that regulatory bodies are there to try and answer complaints and protection. Although they also believe that technology has made regulation specifically hard to regulate. This as a result can justify why you cant stop people from breaking copyright laws as it shows that the internet is so vast and wide lots of people can get away with copyrighting people media products and recreating the same thing without anyone realising. This can be seen through dupes of products such as Shien there they make cheap products that are exactly the same as the expensive and original versions.
On the other hand, it is possible to stop people breaking copyright laws due to the intellectual property act. This act states that your work is your own and people cannot use it unless you have given permission, this means people can be taken to court if they have or tired to steal or copy your work in any way. This can be justified by the idea of passive audiences as people who just accept the the content they see will not feel inspired to create or copy what they see and as a result just accept what they see and not have a connection with anything they see in the media. An example of intellectual property act would be logos, designs anything that you have created and have applied to be copyrighted and therefore people cannot use it be stopped due to these laws.
Another reason why it is possible to stop young people from breaking copyright laws is due to Collaboration. This is due to Jenkins theory of participatory culture which describes how people can work together to create and share content in online communities rather than berating people for breaching instead create a more collaborative culture and encouraging prosumers. This as a result can justify that is is possible as its becoming more likely for people to work together on creating products and sharing ideas instead of keeping work to yourself and reporting people for breaching laws so therefore people aren’t breaking the laws as it is becoming more likely for people to work together than against each other.
- Collaboration and participatory culture - Jenkins - the theory of participatory culture describe how people can work together to create and share content in online communities rather than berating people for ‘breaching’ we should create a more collaborative culture and encourage prosumers
